Prenuptial Agreements
Pre-marriage agreements (often known as prenuptial agreements) are still not fully recognised in the Courts in England and Wales. Although they are common and recognised in other parts of the world, a pre-marriage agreement in this country will only be one of the matters the court would consider when determining what is a fair distribution of family wealth.
Courts are, however, beginning to come around to the idea that these should have more weight but certain procedures must be followed in order to maximise the chances of such an agreement either being followed in its entirety by a family court or influencing the court for a more favourable outcome for the person who is seeking to rely on it.
